Parking Rules

  1. All homeowners have a minimum of two parking spaces which includes one in the garage/carport, and one in the driveway, as provided by the Covenants and Restrictions. At no time shall any person park a vehicle, partially or totally, in another resident's space without permission. 
  2. No Parking will be allowed on the grass, in the road, and in “NO PARKING” designated areas. 
  3. Subject to the limitations herein specified, two types of unassigned common area parking spaces are available as needed for (i) Owners, (ii) tenants of Owners, as hereafter defined (“Tenants”), and (iii) temporary guests, as hereafter defined (“Guests”), for additional parking beyond the two (2) assigned spaces per Living Unit. 

Said common area parking spaces are as follows:
A. Unassigned parking spaces located adjacent to the Clubhouse (“Clubhouse Spaces”):
Clubhouse parking spaces (overflow parking) may only be utilized by Owners, Tenants, and Guests. Vehicles are allowed to be parked in this area for no more than 48 hours (after which it must be moved) and must have current tags and be operable.

The parking spaces in front of the clubhouse are strictly for clubhouse users ONLY!  Overnight parking is not allowed in this front row of parking spaces adjacent to the clubhouse. 

B. Other unassigned parking spaces located throughout the properties (“Guest Parking Spaces”). “Tenants,” as used herein, shall mean (i) any person or entity who is a tenant of a Living Unit, and/or (ii) any person or entity that pays any amount of rent or other compensation for staying in said Living Unit, and/or (iii) any person or entity that occupies said Living Unit pursuant to a lease or sublease or other similar written or verbal agreement of occupancy.

Guest and/or Open Parking Spaces may be utilized ONLY for parking by Guests visiting and/or residing in a Living Unit on a temporary basis as a Temporary guest of the Owner; said definition of “Guests” shall not include Tenants and Tenants may not use Guest Parking Spaces. Temporary is defined as a maximum of one month. However, neither residents nor visitors may use these spaces for long-term parking.  Long-term is defined as parking beyond a 48-hours period. If a guest must stay longer than the 48-hour period, please notify RRS or the courtesy officers and they will seek the Board’s approval for extenuating circumstances. You will be notified if the Board approves. A picture of the vehicle including the details of the make and model must be submitted.

 

Any vehicles not complying with the foregoing definition of Guest Parking Spaces may be towed by the Association without further notice.

  1. The only vehicles authorized to be parked on the properties, common areas, or individual lots, are passenger vehicles, pick-up trucks, and vans under 6000 lbs. Watercraft, trailers, and RVs are not authorized. Contact Property Management for designated space for such vehicles. NO commercial vehicles are permitted to park in The Colonies community.
  2. No vehicles of any type shall be permanently or semi-permanently parked on the properties or near any Living Unit or Common Area for repairs or reconstruction. No vehicles are to be stored on the property. All vehicles must be moved or driven within 48 hours.
  3. No vehicle shall be parked within the boundaries of The Colonies without current registration. All vehicles must display the proper license plate and be in operable and daily drivable condition.
  4. Vehicles found in violation of these rules will be towed by Jim’s Garage. All towing and storage fees are the responsibility of the owner.

 

The HOA owns and maintains the following roads within The Colonies community:

Olde Colony Trail:       8709 - 8707/8705 - 8703 - 8701 - 8400/8500 - 8600 

Olde Pioneer Trail:      804 - 811/839 rear and front parking - 808.

Per article V111 section 1 #A - The HOA can adopt rules and regulations concerning the use of these private roads. The HOA does not allow anyone, anytime to park on these roads as they are of narrow construction and within our agreement with our fire insurance carrier and emergency vehicle providers, the HOA has to maintain 21 feet of open width on their roads. This section also gives the HOA the right to assign penalties to those that do choose to ignore their rules and park in these roads.
